Privacy Policy of BEYOND GLØIRE

Effective as of July 2025

The protection of your personal data is of paramount importance to BEYOND GLØIRE. All data is processed in strict compliance with the Swiss Federal Act on Data Protection (revDSG) and, where applicable, the European Union’s General Data Protection Regulation (GDPR). We expressly reserve the right to assert our legal rights to the fullest extent permitted by law and to disclaim any liability exceeding our statutory obligations.

By using our services, you expressly consent to the following Privacy Policy.

1. Collection and Processing of Personal Data

a) Website Access Without Registration
When visiting our website without registering an account, we do not actively collect any personal data. However, certain technically necessary information may be collected automatically through the use of cookies (see Section 5). Such processing is based on our legitimate interest in ensuring the security and functionality of our platform. Users remain solely responsible for properly configuring their browser and device settings.

b) User Account and Orders
Creating a user account is mandatory for accessing our services. We collect the following data for account registration and processing:

  • First and last name

  • Email address

  • Telephone number

  • Shipping and billing address

  • Order history and payment status

Payment data is additionally collected through our certified payment service providers. Such data is processed solely by the respective third-party provider. BEYOND GLØIRE assumes no liability for any loss, error, or misuse of data attributable to such third parties.

c) User Responsibility and Duty to Provide Accurate Information
Users are required to provide complete and truthful information and must update any changes without undue delay. False declarations or omissions entitle BEYOND GLØIRE to suspend or delete the user account and to initiate legal proceedings where appropriate.

2. Purpose and Legal Basis of Processing

Data is processed exclusively for the following purposes:

  • Fulfilment of pre-contractual and contractual obligations

  • Provision of services and customer support

  • Fraud prevention, payment security, and legal compliance

  • Enhancement of system stability and user experience

Any processing for additional purposes (e.g. marketing) will occur solely with the user’s explicit consent.

3. Marketing and Right to Object

Where users have provided their explicit consent, we may contact them regarding new products, special promotions, or exclusive offers via:

  • Email

  • SMS / RCS

  • Postal mail

Users may revoke their consent at any time; such revocation shall not have retroactive effect. BEYOND GLØIRE reserves the right to continue sending communications for a short period due to technical constraints. Liability for any resulting confusion or inconvenience is expressly excluded.

4. Data Security and Limitation of Liability

We apply appropriate technical and organisational measures to protect your data. Nonetheless, BEYOND GLØIRE accepts no liability for data loss, unauthorised access, hacking, or errors committed by third parties that are beyond our control. In particular, we disclaim any responsibility for indirect or consequential damages arising from data breaches caused by third-party actions.

5. Cookies and Tracking Technologies

Our website uses cookies, tracking pixels, and similar technologies for:

  • Essential system functions (e.g. login, language settings, shopping cart)

  • Analytics purposes (e.g. Google Analytics)

  • Performance optimisation and improved user experience

Users may disable such technologies through their browser settings. BEYOND GLØIRE is not liable for impaired functionality resulting from such user configurations or third-party software.

Use of Meta Pixel and Conversion API

In addition to the technologies mentioned above, BEYOND GLØIRE utilises the Meta Pixel and the Conversion API, services provided by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland. These tools enable the tracking of actions performed by visitors after interacting with our advertisements on Facebook or Instagram, and thereby serve the legitimate purpose of measuring and analysing the effectiveness of such advertisements, optimising future marketing strategies, and conducting statistical and market research.

The categories of data transmitted to Meta may include, without limitation, HTTP header information, Pixel ID, device identifiers, information about the browser and operating system used, user click behaviour, IP address, geolocation (where enabled), and – if voluntarily provided during account creation or order placement – hashed values of email addresses or telephone numbers. Such transmission occurs in encrypted form, using state-of-the-art security protocols.

Meta may, in accordance with its own Data Usage Policy (https://www.facebook.com/about/privacy), associate the transmitted data with a user’s Meta account and process it for its own advertising purposes, including but not limited to the creation of user profiles, the provision of targeted advertising, and the placement of advertisements across Meta’s partner networks. We explicitly disclaim any responsibility for the type, scope, duration, or purpose of processing conducted by Meta.

BEYOND GLØIRE does not receive any data from Meta that would enable us to identify you personally; all evaluation of campaigns remains at an aggregated and anonymised level. Nonetheless, due to the technical integration of Meta tools, we cannot fully exclude that data may be processed outside of Switzerland or the EU/EEA (e.g. in the United States). Where such transfers occur, they are subject to recognised safeguards such as the EU Standard Contractual Clauses or adequacy decisions. However, absolute data security abroad cannot be guaranteed, and BEYOND GLØIRE hereby disclaims any liability for data processed by Meta or its affiliates outside of Swiss or EU jurisdiction.

The legal basis for such processing is Art. 6(1)(f) GDPR and the corresponding provisions of the Swiss revDSG, reflecting our legitimate interest in effective, data-driven online marketing and the continuous improvement of our services.

Users who are logged into Meta services may, at any time and with effect for the future, object to the collection and processing of their data for advertising purposes by adjusting the relevant settings under https://www.facebook.com/settings?tab=ads. We expressly draw attention to the fact that such objection does not affect the legality of processing carried out prior to the objection and that technical delays in implementation may occur, for which BEYOND GLØIRE assumes no liability.

By continuing to use our services and website, users explicitly acknowledge and accept the integration of the Meta Pixel and Conversion API, as well as the associated processing and transfer of data as outlined above.

6. Data Retention and Deletion

Personal data is retained only as long as necessary to fulfil the stated purposes or legal obligations. Early deletion shall occur only where no statutory or contractual retention duties apply.

7. Your Rights (Subject to Statutory Limitations)

You have the rights afforded to you under the revDSG and, where applicable, the GDPR. BEYOND GLØIRE reserves the right to refuse access or rectification requests where overriding interests of our company or third parties apply (Art. 26 revDSG).

8. Data Disclosure to Third Parties

We disclose personal data to third parties (e.g. payment processors, logistics partners) solely in compliance with applicable laws. We explicitly disclaim any liability for the conduct, security measures, or data protection practices of such third parties. Users must independently review and accept the respective privacy policies of any third-party service providers prior to use.

9. Data Processing Abroad

Where data is processed outside of Switzerland, this is done exclusively in accordance with legally recognised safeguards (e.g. adequacy decisions, standard contractual clauses). Nonetheless, full data security cannot be guaranteed abroad. The user explicitly consents to the potential transfer of data to such countries.

10. Protection of Minors

Our website is not intended for use by individuals under the age of 16. We do not knowingly collect data from minors. Parents or legal guardians are fully liable for any use of our services by their children.

11. Changes to this Privacy Policy

We reserve the right to amend this Privacy Policy at any time. The current version is always available on our website. Significant amendments may be communicated separately.

Additional Disclaimer of Liability

Use of this website is undertaken at the user's own risk. BEYOND GLØIRE disclaims all contractual and non-contractual liability—particularly for indirect, consequential, or incidental damages—in connection with the processing of personal data, to the fullest extent permitted by law. Collective claims, class actions, or public complaints (e.g. via media, forums, or social networks) are expressly excluded.
