These Terms and Conditions ("T&C") govern the use of the website operated by BEYOND GLØIRE, as well as all related services. By accessing our website or purchasing products from us, you agree to be bound by these terms, along with all other applicable policies (e.g., Privacy Policy and Return Policy).

1. Entity and Scope of Application

This website is operated by BEYOND GLØIRE. The terms "we", "us" and "our" refer to BEYOND GLØIRE. By using our services, you confirm that you are of legal age and have the legal capacity to accept these T&C.

2. Use of the Website and Services

Using our website or products for illegal or unauthorized purposes is strictly prohibited. Violating applicable laws (including intellectual property rights) is also forbidden. We reserve the right to refuse service at any time without stating a reason.

The transmission of malicious software (e.g., viruses, worms) is strictly prohibited. Any violation will result in immediate termination of access to our services.

In cases of suspected abusive behavior (e.g., automated entries, misuse of coupons, fake orders), we reserve the right to permanently block access.

3. Accuracy and Timeliness of Information

We accept no liability for the accuracy, completeness, or timeliness of the content on this website. All content serves general informational purposes only. Use is at your own risk.

We reserve the right to modify content at any time but are under no obligation to update information.

Despite careful verification, system- or human-related errors (e.g., pricing errors, incorrect stock levels, technical failures) may occur. We reserve the right to adjust or cancel affected orders in such cases and to refund any payments immediately. There is no entitlement to delivery under such circumstances.

We further reserve the right to cancel or refuse orders in cases where errors occurred in automated systems, product descriptions, or checkout processes, regardless of whether the customer has already received a confirmation. This also applies to typographical or calculation errors.

It is the sole responsibility of the customer to verify all order information, prices, and applicable terms prior to finalizing a transaction. Any reliance on cached, outdated, or misrepresented data shall be at the customer’s sole risk.

4. Product Availability and Changes

Product descriptions, prices, and availability are subject to change without notice. We reserve the right to discontinue products or limit sales on a case-by-case basis.

Product images may vary depending on the display. Binding color accuracy is not guaranteed.

We also reserve the right to introduce new functionalities, tools, or features, which shall automatically be subject to these T&C unless otherwise specified.

Delivery timelines are estimates only. BEYOND GLØIRE assumes no liability for delays caused by third-party logistics providers, customs authorities, or force majeure. Orders may be cancelled or modified at our sole discretion in the event of persistent or unpredictable unavailability.

5. Orders and Account Information

We reserve the right to cancel or limit orders at our sole discretion, especially if we suspect resellers, duplicate accounts, or automated orders.

Customers are obliged to provide current, complete, and accurate account data. Non-compliance may result in order cancellation. Repeated or fraudulent orders will result in account suspension.

6. Right of Withdrawal and Returns

Our return and cancellation conditions are governed by our official Return Policy. Please review it carefully before making a purchase. We reserve the right to reject returns that do not meet our conditions.

Abusive return behavior (e.g., using the item and then returning it, false claims of defects) may lead to restrictions, denial of refunds, or permanent account suspension.

We reserve the right to refuse returns or refunds in cases of suspected manipulation, repeated unjustified complaints, or deliberate harm to the company. In such instances, we may also take legal action or involve collection agencies where necessary.

BEYOND GLØIRE warrants that the products delivered are free from material and manufacturing defects at the time of transfer. The statutory warranty period is two years from the date of delivery in accordance with applicable law; this shall not affect the buyer’s statutory rights.

Independent of the statutory rights, BEYOND GLØIRE grants a voluntary warranty which entitles the customer exclusively to a refund or replacement for defects reported in writing within one year from delivery. The exercise of this voluntary warranty requires the submission of clear photographic evidence of the defect as well as proof that the original packaging remains intact. The costs of return shipping shall be borne by the customer.

Defects must be reported in writing without undue delay upon receipt of the goods. In the case of justified defects, BEYOND GLØIRE reserves the right, at its sole discretion, to remedy the defect, deliver a replacement, or refund the purchase price.

This warranty does not cover damages resulting from improper use, normal wear and tear, ordinary abrasion, or external influences.

Also can the actual product may differ slightly in appearance from the images presented on our website. Such variations may result from factors including, but not limited to, lighting conditions during photography, screen display settings, image editing, and minor production tolerances. These deviations shall not constitute a defect or non-conformity of the product and do not entitle the customer to any form of return, refund, or compensation.

Multiple returns of used products, inconsistent claims, or patterns indicating systemic misuse may result in internal review and permanent revocation of return privileges. Refunds for voluntarily returned items shall be issued only upon full inspection and confirmation of compliance with the applicable return conditions.

7. Third-Party Tools and Links

We may offer tools, applications, or content from third-party providers (e.g., Shopify Payments, analytics, shipping services) over which we have no control. Use of such content is at your own risk and provided "as is."

Please review third-party terms and policies before engaging in transactions. We assume no liability for third-party content, service outages, or data handling.

The use of third-party services is at the sole risk of the customer. BEYOND GLØIRE expressly excludes any liability, regardless of the legal basis, for any direct, indirect, incidental, special, consequential damages, including lost profits, data loss, downtime, or other economic losses arising from the use, malfunction, delay, interruption, failure, or any impairment of these third-party services, to the fullest extent permitted by law.

8. User Content and Behavior

By submitting content (e.g., reviews, comments), you grant us a non-exclusive, royalty-free, perpetual license to use, publish, and distribute this content.

Unlawful, misleading, offensive, or harmful content is prohibited. We reserve the right to moderate or remove such content and to block accounts as needed.

We also reserve the right to take legal action against fake reviews or defamation with the intention of reputational harm.

The publication or dissemination of unverifiable, defamatory, disparaging, or malicious statements targeting BEYOND GLØIRE’s brand, services, personnel, or operations — particularly on platforms lacking formal dispute resolution mechanisms — shall be deemed an act of reputational interference and may be subject to injunctive relief, damages, or criminal prosecution under applicable law.

9. Data Protection

The transmission of personal data is subject to our Privacy Policy.

We reserve the right to retain relevant data (e.g., for completed orders, invoices, or abusive behavior) in accordance with statutory retention periods, even in the case of deletion requests.

10. Prohibited Uses

The use of the website or its content is prohibited in the following cases:

Illegal purposes
Soliciting others to commit illegal acts
Violations of third-party rights
Harassment, discrimination, or abuse
Transmission of malware
Spam, phishing, data scraping
Deception, identity theft, or fake reviews

Attempts to manipulate, reverse-engineer, bypass, or interfere with the website's technical infrastructure — including but not limited to pricing logic, checkout flows, cart functionality, and promotional logic — are strictly prohibited and shall be prosecuted to the full extent permitted by law.

11. Disclaimer of Liability

Our products and services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

Despite all reasonable care, technical or human errors may occur. We disclaim all liability for direct or indirect damages unless caused by gross negligence or intent.

We expressly reserve the right to correct errors in product pricing, stock information, or promotions and to cancel orders placed on that basis.

We are not liable for delays or non-performance caused by force majeure events such as war, natural disasters, pandemics, or governmental actions.

To the fullest extent permitted by applicable law, BEYOND GLØIRE disclaims any and all liability for direct, indirect, incidental, or consequential damages arising from the conduct, omissions, or errors of auxiliary persons as defined in Article 101 of the Swiss Code of Obligations (OR), irrespective of the legal qualification of such auxiliary relationships, unless such damages can be proven to result exclusively and directly from gross negligence or willful misconduct attributable to BEYOND GLØIRE itself, and provided further that no contributory negligence, third-party interference, or unforeseeable circumstances were involved in the chain of causality.

Furthermore, BEYOND GLØIRE expressly disclaims, to the fullest extent permitted by law, any liability for physical, medical, neurological, ophthalmological, or other health-related conditions, injuries, or impairments allegedly arising from or associated with the use, misuse, or perceived insufficiency of optical protection provided by its eyewear products, including but not limited to inadequate ultraviolet (UV) filtration, blue light attenuation, glare resistance, or lens material properties. All lenses are manufactured in accordance with general industry standards and are not intended for use in medically regulated or high-risk environments unless explicitly stated. No representation is made that any product prevents, treats, or mitigates any medical condition. Any use beyond ordinary recreational or lifestyle purposes is at the customer’s sole risk and responsibility.

BEYOND GLØIRE further clarifies that no independent laboratory testing or certification is conducted beyond the information provided by our suppliers. We do not warrant or guarantee specific UV protection performance levels beyond those stated, and we explicitly decline to assume liability for potential deviations in supplier-reported specifications. The customer accepts that all purchases are made with the understanding that BEYOND GLØIRE relies on third-party manufacturer data without further in-house validation or testing. No representation is made that the eyewear is medically certified or intended to prevent optical damage. Any assumptions of safety are made solely at the discretion and risk of the end user.

12. Indemnification

You agree to indemnify and hold BEYOND GLØIRE and its affiliates harmless from any third-party claims arising from your breach of these T&C, violations of the law, or misuse of our services.

This includes but is not limited to damages arising from breach of contract, statutory violations, reputational harm, or technical disruptions caused directly or indirectly by the customer.

13. Severability Clause

If any provision of these T&C is found to be invalid, the remaining provisions shall remain unaffected and enforceable.

14. Termination

These T&C remain effective until terminated by either party. We may terminate this agreement without notice in the event of violations or abuse.

15. Governing Law

These T&C are governed by the substantive laws of Switzerland. The exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be the registered office of BEYOND GLØIRE in Zurich, Switzerland.

Without prejudice to the exclusive application of Swiss law and jurisdiction, and notwithstanding any potential cross-border transactional elements, BEYOND GLØIRE does not voluntarily submit to any foreign consumer protection regimes, including but not limited to Directive 2011/83/EU on Consumer Rights or any other national implementations thereof. Should mandatory provisions of consumer protection law under Art. 6(2) of Regulation (EC) No 593/2008 (Rome I) exceptionally apply to consumers domiciled in EU member states, such provisions shall apply only to the extent strictly required and shall not affect the remaining provisions governed by Swiss law. Any broader interpretation or automatic application of foreign statutory frameworks is hereby expressly disclaimed.

The Customer expressly and irrevocably waives the right to initiate, participate in, or support class actions, group litigation, mass proceedings, arbitration, or any other form of collective legal action against BEYOND GLØIRE.

16. Amendments to the T&C

We reserve the right to amend these T&C at any time. The current version is always available on this page. Continued use of our website constitutes acceptance of the amended terms.

All newly introduced functionalities, features, or services on our website are automatically subject to the current version of these T&C unless otherwise stated.

These Terms and Conditions and all legal relationships between BEYOND GLØIRE and the Customer shall be governed exclusively by the substantive law of Switzerland. To the fullest extent permitted by law, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be the registered office of BEYOND GLØIRE in Zurich, Switzerland. The Customer undertakes to litigate all disputes exclusively before the competent courts of Switzerland. Any transfer of jurisdiction or proceedings in other jurisdictions is hereby excluded. The Customer expressly and irrevocably waives the right to initiate, participate in, or support class actions, group litigation, mass proceedings, arbitration, or any other form of collective legal action against BEYOND GLØIRE. The Customer is prohibited from disseminating, publicly or privately, including via social media, forums, review platforms, or other media channels, any statements or conduct that are defamatory, libelous, disparaging, or otherwise harmful to the reputation or business operations of BEYOND GLØIRE. This prohibition expressly includes the dissemination of false or misleading information. In the event of any violation of these provisions, BEYOND GLØIRE reserves the right to take all appropriate legal measures, including criminal and civil proceedings, as well as claims for damages. Should any provision of this section be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

In the event of discrepancies between translations of these T&C, the English version shall prevail unless explicitly stated otherwise.
